Terms of Service
These are the General Terms and Conditions governing your participation in Supercar Society events and your use of our services. Please read them carefully.
1. Definitions
In these general terms and conditions, the words below have the meaning given behind them:
- 1.1. General terms and conditions: these general terms and conditions of Supercar Society;
- 1.2. Visual material: photos, videos and other visual material;
- 1.3. Participant: the consumer who registers for an event of Supercar Society;
- 1.4. Event: any activity organized by Supercar Society;
- 1.5. Agreement: the distance agreement between parties regarding an event;
- 1.6. Parties: the participant together with Supercar Society;
- 1.7. Supercar Society: the general partnership Supercar Society V.O.F. located in Enschede, registered with the Chamber of Commerce under number: 74375296;
- 1.8. Vehicle: a vehicle registered by a participant for the event and/or driven by the participant during the event;
- 1.9. Website: the website connected to the domain name https://www.supercarsociety.nl.
2. Applicability
- 2.1. These general terms and conditions apply to all agreements and/or assignments between Supercar Society and the participant.
- 2.2. Any deviations from these general terms and conditions can only be made through written agreement.
- 2.3. Supercar Society has the right to change these general terms and conditions at any time.
3. Offer
- 3.1. All offers regarding Supercar Society events are without obligation.
- 3.2. Supercar Society cannot be held to offers if they contain a mistake, typo or printing error.
- 3.3. The prices stated in the offer are exclusive of VAT, unless stated otherwise.
4. Registration and agreement
- 4.1. The participant can register both in writing and verbally for the relevant event and thereby accept the offer. The participant must provide the specified information completely and accurately.
- 4.2. At the time of registration, the participant must have reached the age of 18.
- 4.3. The participant declares that all details provided by the participant to Supercar Society are accurate and complete and have been provided entirely truthfully. The participant obliges to notify Supercar Society of changes regarding the details when necessary, so that the participant guarantees that the details remain accurate, complete and truthful. Supercar Society is not responsible for initiating an investigation into the accuracy and completeness of the information provided by the participant.
- 4.4. Supercar Society is entitled to reject the registration without giving reasons.
- 4.5. After approval of the registration, the agreement comes into effect on the day that Supercar Society sends a confirmation of registration to the participant.
5. Participant's right of withdrawal
- 5.1. The participant may dissolve the agreement with Supercar Society during a reflection period of 5 days, without giving reasons.
- 5.2. The 5-day reflection period described in point 5.1 runs from the moment Supercar Society has accepted the participant's registration via a confirmation and the agreement between the parties has therefore been established.
- 5.3. When withdrawal is requested by the participant, Supercar Society is obliged to refund the paid transaction to the participant within 14 days.
6. Organization
- 6.1. Supercar Society is entitled to transfer or outsource the execution of the agreement in whole or in part to a third party or parties as it sees fit.
- 6.2. Supercar Society is entitled to make changes to the schedule of an event without prior notice.
7. Legislation, regulations and insurance
- 7.1. The participant must at all times comply with all local laws and regulations.
- 7.2. The participant explicitly grants Supercar Society permission to provide the participant's personal information to third parties if this is necessary for the execution of the agreement.
- 7.3. The participant must be fully authorized to drive during the event and is obliged to carry a valid vehicle registration.
- 7.4. The participant is obliged to adequately insure the vehicle and themselves. An adequate insurance means at least: a. statutory liability insurance; b. insurance against personal injury and/or death; c. health insurance; d. insurance against property damage. The participant must carry the insurance papers for the aforementioned insurances during the event.
8. Participant codes of conduct
- 8.1. The participant is obliged at all times to follow directions and/or instructions given by Supercar Society.
- 8.2. The participant must safeguard the safety of others and themselves during the event. As soon as the participant's driving ability decreases, the participant may not drive any vehicle during the event.
- 8.3. The participant is not permitted to bring or carry (hard) drugs, alcoholic beverages, fireworks, (fire)arms or other dangerous objects during the event. The participant is also not permitted to drive a vehicle during the event under the influence of (hard) drugs or other narcotics and/or alcoholic beverages.
- 8.4. Participants are not permitted to compete with each other during the event, for example regarding speed.
- 8.5. The participant is not permitted to enter into bets – in any form whatsoever – with other participants or visitors.
9. Sponsors and stickers
- 9.1. The participant is not permitted to advertise, for example, other events, companies and/or products, without prior written permission from Supercar Society. If this permission is lacking, Supercar Society is authorized to remove the participant from the event without the participant being entitled to a refund of the fee already paid to Supercar Society.
- 9.2. The participant grants Supercar Society permission to place stickers on their vehicle.
- 9.3. Supercar Society cannot be held liable for any damage that occurs during the application and/or removal of the stickers.
10. Event visual material
- 10.1. Supercar Society will produce visual material of (parts of) the event and the participant.
- 10.2. The participant agrees that Supercar Society publishes visual material of (parts of) the participant on the website and other social media. The participant may only submit a written request to adjust the visual material in such a way that (parts of) the participant are made unrecognizable.
- 10.3. The participant is only entitled to produce visual material for personal and non-commercial use, unless Supercar Society has given written permission for this.
11. Participant's risk
- 11.1. During the event, the participant bears the risk for lost, stolen and/or damaged goods or vehicles, as well as accidents, injuries and/or other calamities.
- 11.2. The participant is responsible for the items they carry during the event or for the items in the vehicle. The participant bears the risk for the consequences of carrying the relevant items.
12. Refusal of participation
- 12.1. If the participant violates an article from these general terms and conditions, Supercar Society is entitled to remove the participant from the event without the participant being entitled to a refund of the fee already paid to Supercar Society. The participant bears full risk for (any) damage arising from the violation of an article from these general terms and conditions. The participant indemnifies Supercar Society for the damage and Supercar Society is entitled to invoice the caused damage to the participant.
13. Booking conditions and cancellation
- 13.1. The participant must notify Supercar Society of the cancellation in writing.
- 13.2. If the agreement is canceled by the participant, Supercar Society applies the following cancellation policy:
- Cancellations made more than 60 days before the event are eligible for a full refund of the registration fee.
- Cancellations between 59 and 46 days before the event are eligible for a refund of 75% of the registration fee.
- Cancellations between 45 and 29 days before the event are eligible for a refund of 60% of the registration fee.
- Cancellations between 28 and 15 days before the event are eligible for a refund of 40% of the registration fee.
- Cancellations between 14 and 8 days before the event are eligible for a refund of 15% of the registration fee.
- Cancellations from 7 days before the event are not eligible for a refund of the registration fee.
- 13.3. If details provided by the participant prove to be incorrect, and this results in costs, these costs will be invoiced to the participant.
- 13.4. The registration fee is not transferable to other persons or future events.
- 13.5. Under no circumstances is the participant entitled to a refund of the amount due.
- 13.6. Cancellations are only valid after the participant has received a written confirmation from Supercar Society. Supercar Society strives to provide the confirmation within 24 hours after receiving the cancellation.
- 13.7. In exceptional situations, such as illness, a credit may be offered in consultation that can be used within 12 months for a future event. However, this is at the discretion of Supercar Society.
14. Payment
- 14.1. After the agreement has been established, and the reflection period of 5 days, described in point 5.1, the participant will receive an email containing an invoice regarding the event for which the participant has registered.
- 14.2. The participant must pay the amount due to Supercar Society at the latest within the term stated on the invoice.
- 14.3. If the participant has not paid the amount due within the agreed payment term, Supercar Society will notify the participant of this and the participant must pay the outstanding amount within fourteen (14) days after the payment reminder. If costs are incurred by Supercar Society to collect the amount due, these costs will be charged entirely to the participant.
15. Liability
- 15.1. Supercar Society accepts no liability for any damage, unless explicitly stated in this article. The limitation of liability does not apply if the damage is due to intent or gross negligence by Supercar Society and/or its subordinate(s).
- 15.2. Supercar Society is not liable in the event of force majeure. Supercar Society is not obliged to fulfill any obligation towards the participant if it is hindered from doing so as a result of a circumstance that is not due to its fault, and for which it cannot be held accountable by law, a legal act or generally accepted views.
- 15.3. Supercar Society's liability is at all times limited to the amount that will be paid out under Supercar Society's liability insurance in the relevant case. If Supercar Society's insurer does not pay out, or only partially pays out, Supercar Society's liability is limited to the maximum amount invoiced to the participant.
- 15.4. Attending an event is entirely at the participant's own risk.
- 15.5. Supercar Society is not liable for: a. damage as a result of loss, damage or theft of an item belonging to the participant brought to the event; b. damage to the participant caused by another participant or visitor to the event; c. personal injury – including accidents, injuries and/or other calamities – of the participant as a result of attending the event; d. damage that the participant may suffer as a result of the participant not providing the correct information to Supercar Society.
- 15.6. If a participant is denied entry to a country or city, Supercar Society is not responsible and liable for the resulting costs and damage.
16. Final provisions
- 16.1. If for whatever reason any of the aforementioned points proves to be illegal or unenforceable, this means that all other aforementioned points fully retain their legal validity and therefore remain enforceable. Parties already agree to replace an invalid point with a valid point that most closely approximates the original intent of the intended statement.
- 16.2. Any disputes between the participant and Supercar Society can exclusively be submitted to the competent Dutch court in the district of Overijssel. These general terms and conditions and the underlying contractual value will exclusively be determined by applicable Dutch laws and, if relevant, will be judged under Dutch law.
